Westchester Residents Beware – Astorino’s Version of a Reformer

DISTRICT #3 has elected a truly ETHICALLY-CHALLENGED representative.
His name, and Astorino’s hand picked candidate who he labeled a reformer, is Michael Smith.
(Makes you question what kind of reform Astorino is looking for!!)

It is essential that as we move forward voters keep a very sharp eye on Smith.

Yes, Smith opposes abortion even in cases of rape, incest or to save the life of the woman.

In addition, Smith has a very questionable history at best. He seems willing to do anything to win. Nothing is off limits. 

To win this election, Smith ran ads about Legislator Nonna that were intentionally misleading–that’s not just our opinion but the findings of the non-partisan Fair Practices Campaign who found him guilty. Smith also apparently ran an equally offensive and untrue recorded phone call to voters on Election Day to scare them into voting for him. And that’s just the beginning.

the New York State Controller found to be illegal as did the New York State Supreme Court.

“Mike Smith’s record speaks volumes”

“As a taxpayer in the Valhalla school district I am still amused that Mr Smith is running as a tax cutter. He is anything but. In his first 3 years on the Valhalla BOE spending rose 21%. The increase one year before had been 8.8% so where were the cuts?

He is now opposing the $1 a year county lease for the children’s museum, but never opposed Valhalla’s $1 a year Easter Seals lease, the district lost $2.4 million on that deal.

When state auditors shut down the illegal Westhelp scam, Mike Smith voted to sue his own town to restart the illegal payments. He had no problem spending school district money on:

  • Matching Grants to the Valhalla Schools Foundation even though it is illegal to fund private foundations with government money.
  • Two full time salaries for Kensico School Principal
  • Pay his own expense at a private school
  • Donations to Easter Seals, another private foundation.
  • Summer trips to the Grand Canyon
  • Trips to the opera
  • Dinners at trendy NYC restaurants
  • Adult Ice Skating at Rockefeller Center
  • Ocktoberfest at Bear Mountain
  • A moonlight booze cruise on the Hudson 

Despite Mr. Smith’s denials to the contrary, the Booze Cruise was on his watch, in August of 2006
Here are quotes from the 2008 NY State audit of Mike’s Smith’s Valhalla school district finances:

“District officials did not maintain complete and accurate accounting records to facilitate the proper and timely monitoring of the WestHELP Grant. As a result, of the approximately $1.7 million expended for the Grant, approximately $456,000 was not expended in accordance with the Grant agreement, proposals or applicable laws”

“The [Valhalla] Board did not provide sufficient oversight over District financial operations”

“The District overpaid for the Business Administrator’s life insurance premiums by $38,500”

“Internal controls over payroll were not adequate”

“The District did not have adequate controls over the payroll process”

‘District officials did not implement an effective system of internal controls to safeguard computerized data’”

Smith has proudly said that he stands by the contract. That illegal support will now cost Valhalla School District residents over a million dollars. Smith’s willingness to stand by a clearly illegal contract should worry Westchester residents.

Unofficial Election Results!

This was the Ultimate Battle against Goliath, and Goliath lost!
We the Pro-Choice community and Choice Matters took on Astorino’s anti-choice machine and won! We have maintained a pro-choice majority on the Westchester County Board of Legislators, although we did sadly lose an important ally in District #3, John Nonna.
As the Capital Tonight reported, Election Night was “Not A Good Night For Rob Astorino”
Right-to-Life, anti-birth control  anti-sex education County Executive Rob Astorino vested heavily in this election even though his name was not on the ballot.He handpicked the candidates to target Democratic pro-choice incumbents.Astorino recruited his political consultant Bill O’Reilly to manage the campaign of his handpicked, rubber stamp, predominantly anti-choice candidates.Then Astorino found the big money for his campaign. He knew he wouldn’t find those anti-choice dollars in Westchester so he headed to Albany.According to The Wall Street Journal,  the NYS GOP–the same anti-choice extremists who back the likes of Senator Skelos–invested in excess of $100,000 in Westchester County’s 2011 County legislature races.

Why? Apparently Astorino is considered a rising star and a possible challenger to Governor Cuomo in 2014. (GOP Viewing Westchester as a Big Test, 11/8/2011)

(According to the Right to Life Committee, the incumbent  also supports passing a law to ban gay marriage.) Unfortunately, it appears at this time that Fitzpatrick is behind by 39 votes. Also candidates in the open seat in District #6, Dan Brakewood, and the challenger in District #1, Mike Kane, were unable to come out on top of the  anti-choice opposition.

Bill
Ryan has been an active and vocal advocate for Choice since his early days in the NYS Assembly. In his first campaign for the County Legislature, he pledged to continue fighting for a woman’s right to choose and he has done so without fail. Ryan has “more faith in women making the right decision for themselves than in government making it for them…” and believes, “a woman’s right to choose is absolute and should not be subject to legislation.” Ryan also serves on the Large Urban County Caucus in the National Association of Counties He is one of 35 county officials representing over 140 million people, living in the 100 largest counties in America, on matters before the federal government. Ryan’s opponent, although rated pro-choice, will not commit to supporting the clinic access bill that protects women as they enter and leave reproductive health centers. She says she’s a novice whose ideas are still cooking—but in reality, she has been politically active for years and served on Astorino’s transition team. Choice Matters’ choice is Bill Ryan!

Daniel Brakewood is committed to women’s reproductive health. As a current Port Chester trustee, Brakewood has proven himself to be an independent voice for his constituents. Fitzpatrick’s opponent who is endorsed by the Right to Life Party, is an extremist who opposes abortion even in cases of rape, incest or to save the life of the woman. Cuts Funding for Contraception for Teens, Well-Baby Care and Sex Education

This is outrageous! Less than three months after the Department of Health and Human Services announced that contraception is so important that it is being designated preventive care, in accordance with the recommendations of the Institute of Medicine, and joining the list of key services such as mammograms, cervical cancer screenings, prenatal care, well-woman visits, and gestational diabetes screenings, Astorino puts his right-to-life, anti-birth-control, far-right mentality into action, attacking our teenagers’ health and rights.

Nothing seems more like preventive care than contraception!

Why is Astorino doing this? This is clearly not about reducing our taxes or about jobs.

Just like the tea baggers in Congress who are seizing every opportunity to attack women’s reproductive rights, Astorino has chosen this moment, when Westchester has sky rocketing unemployment and depleted tax revenues to put his personal anti-choice tea party stamp on our county.

Simply not funding contraceptives and not teaching sex ed does not make sex go away. Instead, it will most likely lead to a dramatic increase in teen pregnancies.

When these babies are then born there will be no well-baby care available because Astorino has cut that too.

Astorino is the true embodiment of the right-to-life philosophy: care about the fetus, but when it’s born, throw it and its mother under the bus.

Who is most effected by Astorino’s actions? Anyone who  utilizes any one of Westchester County’s community health centers—teenagers, the unemployed, the working poor, those without health insurance.

Who won’t it affect? Astorino and his financially secure friends.

Astorino has hand-picked candidates to challenge incumbents. The Astorino gang have all sworn their allegiance to him as attested to at the press conference held on October 7th. On the steps of the County office building and in their own press releases, these candidates have said they will be a [guaranteed] vote for the Astorino agenda and that they share his [governing] philosophy more than 99% of the time.

That means they too believe in outsourcing jobs including the Community Health Centers, as well as cutting funding for contraceptives for teens, well-baby care and sex ed.

Astorino and his gang are committed to creating a sick Westchester, not a healthy one!

2011 – The Number of Abortion Restrictions At An All Time High

According to a new Guttmacher Report, in the last six months—from the beginning of January through the end of June—states across the country have enacted a record breaking 162 new laws or changes to current law that impact our reproductive health care and rights. Of those, 49% (80 new laws!) are targeted at restricting access to abortion. The 80 new laws are more than double the record set in 2005 of 34 enacted restrictions, and triple last year’s number of 23.

New laws in five states seek to ban abortion completely after 20 weeks, and Ohio wants to ban it as soon as a fetal heartbeat can be detected, at approximately eight weeks. (All of this appears to conflict with existing Supreme Court precedent that prohibits bans on abortion prior to viability, which occurs  several weeks later—but with today’s Supreme Court, who knows.) These 2011 changes have all occurred in just 19 states.

New York?
The bad news is that it can and is happening here in New York.

Just last week, a Federal Court judge for the Southern District of New York, Federal Judge William Pauley, blocked New York City from enforcing its new law requiring Crisis Pregnancy Centers (CPCs)* to disclose what services they do and do not provide. The focus of the law was/is transparency. It had been carefully studied to ensure protection of First Amendment rights of all involved.

The meaning inherent in the judge’s decision is that it is okay to trick women, and to mislead us about to the full range of medical services of which we might legally avail ourselves.

In Albany every year, we battle back against anti-choice legislation. This past May, Assemblyman Katz, newly elected to represent the 99 A.D., introduced a bill, A07841, that calls for “no state aid allocated, transferred, or given to the organization known as Planned Parenthood or any of such organization’s affiliated entities or any organization which performs abortions.”  Our pro-choice elected officials were waiting!

Even under a Democratically controlled State Senate in 2009, we could not get a vote to pass the much needed Reproductive Health Act that would update New York State’s abortion law, establish a fundamental right to reproductive privacy, treat the regulation of  abortion as an issue of public health and medical practice, and remove it from the penal code provisions.

The Vote
We are represented by those whom we elect. Last November, voters across the country turned out in droves to vote for anyone promising to reduce taxes and who was not an incumbent—no questions asked. No questions about Choice, about Jobs, about the Environment-nothing. Candidates only needed to disparage the then-office holders and all existing programs. They were not asked to offer a single concrete course of action.

And it worked. Disguised as concerned citizens, extremists with right-wing anti-social agendas were able to get elected to State and Federal government. The key was to avoid discussion about social issues but to promise key supporters to advance their ultra-conservative agendas.

That is exactly how we ended up with this record-breaking number of anti-abortion restrictions. Our rights are too hard to come by to allow this to happen again, not in Albany, not in Westchester County and not in Washington D.C.

Westchester Magazine Perpetuates Rep Hayworth Deception

In response to Westchester Magazine’s June article  claiming Hayworth is pro-choice (click here to read)

Nan Hayworth is not pro-choice. Prior to her election, she expressed support for restricting Choice, and support for the Stupak Amendment. After her election she has voted against reproductive rights multiple times:

– She voted for the Pence bill to cut all funding to Planned Parenthood and all of their cancer screenings, STI testing, birth control and more even though she knows that no federal funds go to abortion now because of the Hyde Amendment;
– She voted to cut all Title X funding and thus the family planning services provided to approximately five million women and men;
– She voted to overturn the Patient Protection and Affordable Care Act.

The fact that she calls herself pro-choice would be baffling if we did not know she simply does it because the voters in her district (19 CD) would never have elected her if they had known she was anti-choice.

And another point, the Westchester Magazine article portrays Nan and her husband as this cute couple in a relationship where she goes to Washington and he stays home with the kids. The truth is that he is also a Washington player. He is Chair of the Board of Directors of the American Medical Group Association — a group that lobbies Congress, and thus his wife. I find the idea of a representative from our area being married to a lobbyist, voting on healthcare issues to be troubling.

County Executive Astorino ‘Blesses’ Sexual Harassment Email

The Sequence of Events
**Tuesday, May 10th, George Oros, who is County Executive (CE) Rob Astorino’s Chief of Staff, and the CE’s Liaison to the Board of Legislators (BOL) and a former County Legislator himself, watched a live in-house broadcast of a BOL Committee on Community Services meeting at which closure of mental health facilities was being discussed.  The closure of these centers affects thousands of Westchester residents and is being proposed by the CE.

**While Legislator Judy Myers, who is a Democrat representing Rye City, Mamaroneck Town, Larchmont, and parts of the Village of Mamaroneck, New Rochelle and Rye Town and is the only woman in a leadership position on the BOL, was discussing the impact the closures will have on mental health patients, Chief of Staff George Oros expressed his response to her comments with the following email:

“Judy sounds so breathless – “ooooohhhhh yeeeeesssss.”

**Oros, at 4:02 p.m., emailed the above to Legislator Myers. Some say he did this accidentally—maybe yes, maybe no.

Oros – Disrespecting and Insulting ALL Women
As Phil Reisman pointed out, George Oros’ email was “… practically a direct quote from Meg Ryan’s fake orgasm scene in “When Harry Met Sally.” (Click here to read Reisman’s comments.)
Oros was not responding to what Legislator Myers was saying. Oros was sexualizing Legislator Myers. He took away her mental capacity and saw only a sexual object.

Legislator Myers was elected by thousands of constituents in her district to represent them on the Westchester County Board.  They thought of her as a bright, articulate individual capable of looking out for their best interests.

Chief of Staff Oros stripped away all of that respect and replaced it with nothing more than the Old Boys Club idea that women serve only as subservient sexual entities.

The Role Modeling of CE Astorino
CE Astorino’s response to this sequence of events was to laugh it off and call it “silly.”

His explanation was that at one time Oros and Myers worked together as legislators and that that somehow made this okay.

Clearly Mr. Astorino does not understand that “harassment in the workplace” means exactly that—harassment by a co-worker in the workplace.

The expression a fish rots from the head applies here and the head is CE Astorino.  He has made it clear that in this administration women are to be second class citizens. There is not one woman—not a single one—in a decision-making position working in the County Executive’s Office.

Oros’ frat house behavior cannot simply be dismissed as boys-will-be-boys. It is not simply silliness, but instead a serious offense.  No one should be permitted to refer to another individual in such a derogatory and demeaning manner.

If it is okay when it happens to an elected official, then it will be okay when it happens to our daughters, sisters, mothers, partners, or aunts. We must be outraged now, before it hits any closer to home.

Take Action
Contact CE Astorino’s office and say, “We will not tolerate that behavior.”

REP. ENGEL – ATTACKS ON WOMEN’S HEALTH THE WRONG MESSAGE

Congressman Eliot Engel (D-NY-17) twice offered an amendment to the so called “Protect Life Act,” (H.R. 358) in an attempt to thwart attacks on women’s health resulting from the Republican bill.   Rep. Rep. Engel’s amendment, defeated Tuesday by the full Energy and Commerce Committee by a vote of 31-19, would maintain current laws which protect both doctors who do not practice abortion and those who do.  The so-called “Protect Life Act,” does away with basic protections except for those health care providers who oppose abortion.  The measure would criminalize anyone who would do the procedure or even educate a woman on her choices.  The House also voted on Friday to pass an amendment to strip funding for Planned Parenthood, a measure Rep. Engel voted against.

“If this irresponsible bill becomes law it would put the lives of women at risk.  It is ironic that a bill titled ‘protect life’ could result in the inevitable loss of life.  These bills are the Republican Majority’s opening salvo in their determined quest to dismantle the existing law protecting a woman’s right to seek medical assistance for her own body.  Make no mistake, this bill may pass the House and then go nowhere, but this is not going to stop the Republican’s attempts to pass more extreme legislation to advance their social agenda,” said Rep. Engel.

“I am sure that there are doctors and nurses who believe that they are morally required to provide a requested abortion to a victim of rape, or in an emergency situation,” said Rep. Engel. “However, the Republican leadership only wants to protect one group’s conscience, and no others.  This is wrong and it’s not fair.”

Unfortunately, pro-choice health providers are not protected by Roe v. Wade, as some claim.  “If a hospital fires a doctor because he performs abortions elsewhere, that’s not protected by Roe v. Wade.  Nor is it protected if a nurse is not given a job because she has provided counseling on abortion.  There are also cases where a hospital chooses to provide training on safe abortion methods and is denied a grant as a result.  This bill does not protect these care providers from discrimination for simply following the law.  I find it to be very disappointing that the Majority refused to protect these doctors and chose instead to advance a political agenda.”

Rep. Engel added, “This bill is not equal conscience-protection, instead it is a government advancement of a particular viewpoint—and we don’t do that in this country.  This is more of the Republican Right ill-advised plan to refight the culture wars of the past.”

“We should not protect one group’s conscience and criminalize another’s; it’s not fair and it’s not right.  We need the two-way protections that exist in current law and my amendment would have provided that.”

Engel.
